Terms of Service

Welcome to My Driving Instructor. These Terms of Service ("Terms") govern your use of the My Driving Instructor mobile application and related services ("Service"). By using our Service, you agree to these Terms.

1. Acceptance of Terms

By creating an account or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use our Service.

2. Description of Service

My Driving Instructor is a platform that connects learner drivers ("Students") with qualified driving instructors ("Instructors"). We facilitate:

• Discovery of local driving instructors
• Booking and scheduling of driving lessons
• Communication between Students and Instructors
• Reviews and ratings

Important: My Driving Instructor is a platform connecting Students and Instructors. We are not a driving school and do not provide driving instruction. All lessons are provided directly by independent Instructors.

3. User Accounts

3.1 Registration

To use our Service, you must:

• Be at least 16 years old (Students) or 18 years old (Instructors)
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorised use of your account

3.2 Account Types

Student Accounts: Free to create and use for finding instructors and booking lessons.

Instructor Accounts: Require a subscription after the initial free trial period. Instructors must be qualified ADI (Approved Driving Instructor) or PDI (Potential Driving Instructor) badge holders.

4. Instructor Requirements

Instructors using our Service must:

• Hold a valid ADI or PDI badge issued by the DVSA
• Maintain valid driving instructor insurance
• Operate a roadworthy, properly insured vehicle suitable for instruction
• Comply with all applicable laws and regulations
• Provide accurate information about qualifications and experience

We reserve the right to verify instructor credentials and remove any instructor who provides false information or fails to meet our requirements.

5. Subscriptions and Payments

5.1 Instructor Subscriptions

Instructor accounts require a paid subscription after the 14-day free trial. Subscription details:

• Subscriptions are billed monthly or annually through the App Store or Google Play
• Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date
• You can manage and cancel subscriptions through your device's app store settings

5.2 Lesson Payments

All payments for driving lessons are made directly between Students and Instructors. My Driving Instructor does not process lesson payments and is not responsible for payment disputes between users.

5.3 Refunds

Subscription refunds are handled according to Apple App Store and Google Play policies. Contact the respective app store for refund requests.

6. User Conduct

You agree not to:

• Provide false or misleading information
• Harass, abuse, or harm other users
• Use the Service for any illegal purpose
• Impersonate any person or entity
• Interfere with or disrupt the Service
• Attempt to gain unauthorised access to our systems
• Use the Service to send spam or unsolicited communications
• Violate any applicable laws or regulations

7. Bookings and Cancellations

When booking lessons through our Service:

• Booking requests are subject to Instructor confirmation
• Cancellation policies are set by individual Instructors
• We encourage clear communication between Students and Instructors regarding scheduling
• My Driving Instructor is not responsible for disputes arising from cancellations

8. Reviews and Ratings

Users may leave reviews and ratings for completed lessons. Reviews must:

• Be honest and based on genuine experiences
• Not contain offensive, discriminatory, or defamatory content
• Not include personal contact information

We reserve the right to remove reviews that violate these guidelines.

9. Intellectual Property

The My Driving Instructor app, including its design, features, and content, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our permission.

10. Disclaimer of Warranties

Our Service is provided "as is" without warranties of any kind. We do not guarantee:

• The quality, safety, or legality of driving instruction provided by Instructors
• The accuracy of Instructor profiles or credentials (though we make reasonable efforts to verify)
• That the Service will be uninterrupted or error-free
• That you will pass your driving test

11. Limitation of Liability

To the maximum extent permitted by law, My Driving Instructor shall not be liable for:

• Any indirect, incidental, special, or consequential damages
• Loss of profits, data, or goodwill
• Any conduct or content of any user or third party
• Any accidents, injuries, or damages arising from driving lessons

Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless My Driving Instructor from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

13. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. You may delete your account at any time through the app settings.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes through the app or by email. Continued use of the Service after changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be resolved in the courts of England and Wales.
